Basic Informations

1.      Environmental Impact Assessment Report (AMDAL) is a study of the significant impacts of activities on the environment, with the aim of serving as one of the conditions for obtaining a standard certificate (SS) or business license (IZIN)

2.      AMDAL must be conducted for each business plan and/or activity that meets the following conditions:

a.      Located outside industrial parks.

b.      Land area ≥ 50,000 m² (square meters); building area ≥ 10,000 m² (square meters).

c.      The scope of business (KBLI) includes types that require AMDAL, such as:

–        KBLI 24202: Non-ferrous metal smelting industry (lead smelting industry). Regardless of whether the land area and building area exceed or are smaller than the relevant regulations, this business activity must conduct an AMDAL.

–        KBLI 13132: Textile refining industry. The conditions requiring AMDAL are: land area ≥ 20 hectares (urban area) and ≥ 30 hectares (rural area); or groundwater usage flow rate ≥ 50 liters/second; or surface water usage flow rate ≥ 250 liters/second.

3.      In Indonesia, every business plan and/or activity must comply with the established plan and applicable regulations. Therefore, before preparing the AMDAL, a technical approval letter in accordance with the business activities of the company must be obtained.

4.      Technical approval letters include:

a.      Traffic Technical Approval Letter: For companies that require AMDAL, a traffic technical approval letter must be obtained.

b.      Emission Technical Approval Letter: If the business activity involves generators or smokestacks.

c.      Wastewater Discharge Technical Approval Letter: If the business generates wastewater and manages its own wastewater (by installing an IPAL sewage treatment plant).

d.      Hazardous and Toxic Waste (B3) Technical Approval Letter: If the business manages or uses hazardous and toxic waste (B3) during production.

e.      Detailed Technical Approval for Hazardous and Toxic Waste (B3): For each business (if the business activity requires preparation of detailed technical information for hazardous and toxic waste B3)

5.      Preparing the AMDAL allows the company to obtain the Environmental Impact Assessment Approval Letter (SKKL), which is one of the conditions for obtaining the standard certificate (SS) or business license (IZIN). However, if the Environmental Impact Assessment Approval Letter has not been obtained, the company will not only be unable to obtain the standard certificate (SS) or business license (IZIN), but also will not be granted permission to carry out construction/installation activities or production operations.

6.      As long as the business is still operating and no changes have been made, the environmental impact assessment will remain valid.

7.      Changes such as modifications in technical specifications, increased production capacity, increased workforce, expansion of business scope, extension of land and/or building area, changes in working hours/business hours, changes in government policies, changes due to natural disasters or other reasons, or failure to carry out activities within 3 years after the issuance of the environmental impact assessment approval letter, will render the existing environmental impact assessment invalid, requiring a new assessment to be conducted.
