1. Trademark assignment refers to the process of transferring trademark rights to another party (whether a company or an individual) through methods such as trademark sale, donation, or inheritance. After the transfer, the ownership of the trademark belongs to the new party. 2. To transfer a trademark, both parties need to meet with a notary to sign the draft of the transfer agreement in person. If it’s not possible to meet in person, the transfer can be carried out under the following conditions: a. If the transferor is a company: · The legal representative or director can authorize the supervisor listed in the company’s articles of association, and the power of attorney does not require embassy notarization or Hague certification. · The legal representative or director can authorize someone else (not listed in the articles), but the power of attorney must be notarized by the embassy or certified under the Hague Convention, and it must specify the trademark transfer. b. If the transferor is an individual: · The individual can authorize someone else to sign on their behalf, but the power of attorney must be notarized by the embassy or certified under the Hague Convention, and it must specify the trademark transfer. c. If the transferee is a company or individual: · The transferee can authorize the supervisor or another person listed in the company’s articles of association, and the power of attorney does not require embassy notarization or Hague certification.

Processing Times : 14 Months Required Documents : 1. If the transfer or/transferee is an individual: · Identity cards or passports of both the transferor and transferee. · Email addresses and phone numbers of both the transferor and transferee. · Addresses of both the transferor and transferee (with the identity card as proof). · Trademark certificate of the transferor. · Original power of attorney from both the transferor and transferee (if required). 2. If the transferor/transferee is a company: A. Indonesian Company (Local/Foreign) · Personal documents of directors: – Indonesian citizens: Identity card, tax card, email address, phone number. – Non-Indonesian citizens: Identity card, passport scan, email address, phone number. · Company’s articles of association and amendments (if any). · Ministry of Justice approval and amendments (if any). · Company’s tax card. · Company’s business registration certificate. · Company’s email address and phone number. · Trademark certificate of the transferor. · Original power of attorney from both the transferor and transferee (if required). B. Foreign Company · Original business license (BL) and the Indonesian/English version. · Original articles of association (AOA) and the Indonesian/English version. · Legal document proving the chairman of the foreign company (if the chairman is not specified in the company’s articles of association). · Identity card or passport scan of the foreign company’s chairman/legal representative, along with email address and phone number. · Company’s email address and phone number. · Original trademark certificate of the transferor, along with the Indonesian/English version. · Original power of attorney from both the transferor and transferee (if required). |
